NOTICE TO BIDDERS

The Board of Trustees of Hudson Valley Community College in Troy, New York (in accordance with Section 103 of Article 5A of the General Municipal Law) hereby invites the submission of sealed bids for:

  • Hudson Valley Community College

    Technology Quad – Phase 1

    Applied Technologies Education Center (ATEC)

 Bids will be received in room 240 of the Hudson Valley Community College Administration Building, 80 Vandenburgh Avenue, Troy, New York 12180 until 2:00 PM local time on Monday, June 17, 2024 at which time all bids will be publicly opened and read aloud. Any bid received after the designated time will be returned unopened and will not be considered.

In accordance with Section 135 of the New York State Finance Law, commonly known as the “Wicks Law,” the work will be divided into the following Separate Prime Contracts:

  • Contract 1: General Construction (GC)

  • Contract 2: Fire Protection Construction (FPC)

  • Contract 3: Plumbing Construction (PC)

  • Contract 4: Mechanical Construction (MC)

  • Contract 5: Controls Construction (CC)

  • Contract 6: Electrical Construction (EC)

Pursuant to New York State Executive Law Article 15-A and the rules and regulations promulgated thereunder, the college recognizes its obligation to promote opportunities for the maximum feasible participation of New York State-certified Minority and Women-owned Business Enterprises (“MWBEs”) and the employment of minority group members and women in the performance of contracts. All bidders are expected to cooperate in implementing this policy. The college hereby establishes an overall goal of 10% for MWBE participation, 5% for Minority-Owned Business Enterprises (“MBE”) participation and 5% for Women-Owned Business Enterprises (“WBE”) participation (based on the current availability of qualified MBEs and WBEs). The total contract goal can be obtained by utilizing any combination of MBE and /or WBE participation for subcontracting and supplies acquired under this Contract. Trades with 0% goals are encouraged to make “good faith efforts” to promote and assist in the participation of MWBEs on the Contract for the provision of services and materials.

Bidders who register as a planholder through the Printer may acquire the bidding and contract documents using the following options:

1.     For a non-refundable fee of Ten Dollars ($10), interested firms may request and receive an electronicdownload of the bidding and contract documents.

2.     For a non-refundable fee of Fifteen Dollars ($15), interested firms may request and receive a CD with electronic copies of the bidding and contract documents. Bidding documents will be shipped upon request and upon receipt of an additional non-refundable shipping charge to cover shipping and handling costs.

3.     For a non-refundable fee of Forty Nine Dollars ($49), interested firms may request and receive printed copy of the complete set. Bidding documents will be shipped upon request and upon receipt of an additional non-refundable shipping charge to cover shipping and handling costs. Only complete sets will be issued. An electronic download or copy on CD will not be provided as part of this option.

A Pre-Bid Meeting will be held on Wednesday May 22, 2024 at 2:30 PM at Hudson Valley Community College. Prospective bidders should meet the project team in front of Joe Bruno Stadium.

Bids shall be sealed and distinctly marked “Hudson Valley Community College, Technology Quad – Phase 1, Applied Technologies Education Center (ATEC),” with the Contractors name and the name of the Contract and Contract Number plainly shown on the outside of the envelope (e.g. Contract No. 1 –

General Construction). Bids will be received until Monday, June 17, 2024 at 2:00 P.M. EST and shall be either mailed to Hudson Valley Community College or hand delivered between the hours of 9:00 A.M. and 4:00 P.M. Monday-Friday, local time at or before the time of the bid opening. The sealed envelope shall be addressed to:

Each bid proposal must be accompanied by a certified check or bank draft payable to the Hudson Valley Community College or a Bid Bond for a sum equal to five-percent (5%) of the Bid.

All questions and/or requests for clarification regarding the contract documents shall be submitted directly through HVCC’s Bonfire Interactive Platform at https://hvcc.bonfirehub.com. Telephone and email inquiries will not be considered. All questions must be received no later than the close of the business day, seven days prior to the bid date. Addenda may be issued during the bid period at the discretion of the Architect and Construction Manager.

These contracts are governed by public bidding laws of New York State, subject to compliance with Article 8 of the New York State Labor Law regarding prevailing rate of wages and exempt from payment of certain sales tax laws of New York State and other government municipalities. Prevailing Wage Rates apply to all work performed for Rensselaer County. A “Performance Bond” and a “Labor and Materials Payment Bond” in the amount of the contract price and the form described in the Contract Documents will be required from the successful bidder.

The Board of Trustees of Hudson Valley Community College reserves the right to waive any irregularities or informalities in bidding or to reject any or all bids or to accept any bid which is in the best interest of the County.
